We are committed to safeguarding the privacy of our website visitors and Service users.

By using our website, you acknowledge and agree that we and our service providers may (1) record chats when you engage with our chat feature and (2) use session replay and other tracking technologies to collect, on a real-time basis, information on how you use and navigate the site.

Information We Collect

Pursuant to our Policy, we use your IP address to help diagnose problems with our server and to administer our Website. Your IP address is also used to gather broad demographic information and other information such as browser type, platform, and connection speed. This information does not, by itself, identify a specific individual.

We do not collect any personal identifiable information unless you voluntarily provide it to us. Our online inquiry forms are found under the “Contact Us” and “Consumer Services” sections. These forms may solicit visitors to voluntarily provide contact information such as name, email address, phone number, social media profile name and business name. It is completely optional for you to complete and submit these forms. Pursuant to our Policy, we use this contact data to facilitate communications with visitors. Customers may receive a follow-up email after submitting our online inquiry form, and may be further contacted only by the means specified by the customer in that form. Users may request email or telephone contact.. We do not sell, trade, or rent your information to others.

We may collect additional information at other times, including but not limited to, when you provide feedback, make a complaint, when you provide information about your personal or business affairs, change your content or email preference, provide financial or credit card information, communicate with our customer support teams or interact with us through our Website, Services applications or digital communication channels.

Additionally, we may also collect any other information you provide while interacting with us and when we manage our customer, client and service provider relationships and while employed by us.

We may also receive your personal information from third parties that we deal with on your behalf and from our clients and service providers. Any information we receive that we are not lawfully required to hold will be deleted or destroyed.

Automated Decisions

To provide an efficient and helpful customer experience we use automated decisioning in how we communicate with you. For example, if you communicate with us via email or SMS/MMS our system will automatically tailor communications with you based on your preferred digital method of communication, without any involvement of human intervention. We may also use automated decisions to detect and prevent fraud, detect and prevent money laundering and determining the most efficient and helpful way to provide our Services to you.

How We Share Your information

Under applicable Privacy Laws we are allowed to use your personal information in the following circumstances:

  1. to provide our Services to you and to fulfill a contract that we have with our clients and you, including to our suppliers or subcontractors insofar as reasonably necessary for providing our services and managing our business. We may disclose your personal information to our insurers and/or professional advisers insofar as reasonably necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, obtaining professional advice, or the establishment, exercise or defense of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

Text Messaging Privacy

No mobile information, including phone numbers, text messaging originator opt-in data, and consent information, will be shared with, transferred to, or sold to third parties.

Text messaging originator opt-in data and consent will not be shared with any third parties, affiliates, or service providers except as required to provide messaging services or as required by law.

Security

FCS has instituted security measures to protect against the loss, misuse and alteration of the information under our control. Our security measures are consistent with current industry standards. Specifically, (i) our network and database are follow industry best security practices; (ii) only authorized employees have access to contact data; (iii) all employees are educated on our privacy policies; (iv) all employees agree to adhere to our privacy policies as a condition of employment; (v) our network and database are password protected and are behind both a firewall and proxy server to ensure security; (vi) our web security is under ongoing scrutiny and review to ensure that it meets industry security standards; (viii) we regularly monitor and review our security measures and compliance with internal policies and industry best practice; (ix) our contracted service providers are contractually bound to comply with the Privacy Laws and have appropriate information security measures and are obligated to keep the information secure; (x) we encrypt your personal information and thereby prevent unauthorized parties from viewing such information when it is transmitted to us.

You acknowledge that the transmission of unencrypted (or inadequately encrypted) data over the internet is inherently insecure, and we cannot guarantee the security of data sent to us by you over the internet and you do so at your own risk.

Access to your information is restricted to authorized employees who have a legitimate business purpose for using it.

Unauthorized use and or disclosure of client and customer information by an employee of FCS is strictly prohibited. All employees are required to maintain the confidentiality of client and customer information at all times and failing to do so will result in appropriate disciplinary measures, which may include dismissal.

Although we take measures to safeguard against unauthorized disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy. Our Website contains links to other sites, including a secure third party payment processor. If you make a payment through our third party payment processor, it does not share your specific credit card information with FCS. It only confirms with FCS that payment has been made and the amount of said payment.

This Privacy Statement for California Consumers (California Privacy Statement) supplements our Privacy Policy. We may ask you to verify your identity and provide us with additional information before acting on any of your requests. We may need to ask you for additional information to make sure we take the action requested for your information. We will only use additional personal information for this verification purpose.

If you use an authorized agent, we may require more information from either the authorized agent or from you to verify that you are the person directing the agent, including asking for signed permission for the authorized agent to submit a request to know or have us delete your personal information. Or we may require you to verify your identity directly with us or directly confirm with us that you gave the authorized agent permission to submit the request.
